CREDIT CARD INFORMATION

We are committed to protecting your privacy and take our responsibilities regarding the security of your credit card information very seriously.

When making an order by telephone, fax or post and paying by credit/debit card your full card data will be held no longer than is necessary to process and despatch your order. Where applicable we will provide you with the customer copy of the credit/debit card receipt and we will keep the merchant copy which will be kept with a printed copy of your order details in a secure area. We are required to keep a record of transaction details for up to 6 years for tax and accounts purposes.

When making an order online and paying by credit/debit card your information will be stored on a third party secure server provided by SagePay who are our online credit and debit card payment processor. SagePay use the latest, most secure technology available, which encrypts all your personal and credit card details so that your credit or debit card details cannot be read as they travel over the Internet. SagePay only make available to Lavatronics part of the card details that is enough for Lavatronics to choose to accept or decline an order. Lavatronics will not be provided with the a full customer card number, only the last 4 digits will be provided for verification purposes. Your credit / debit card information is held in the SagePay secure server area for 31 days in which time Lavatronics must accept payment and process your order or the payment will become void and be indicated as declined on the SagePay system and no longer available to process. Details of all online transations will be held for up to 5 years for tax and accounts purposes.

To prevent unauthorised access and use of your information, we follow strict security procedures in the storage and disclosure of your information, as required by the UK Data Protection Acts of 1984 and 1998. Your credit card information can only be exchanged between you and us.

ONCE YOUR ORDER HAS BEEN PROCESSED AND DESPATCHED WE WILL DISTROY ALL CARD DETAILS BAR THE LAST 4 DIGITS OF YOUR CARD WHICH ARE SAVED ON FILE WITH YOUR ORDER FOR CROSS REFERENCE PURPOSES ONLY.

RISK OF LOSS

All items purchased from Lavatronics are made pursuant to a shipment contract. This basically means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

PRODUCT DESCRIPTIONS

Lavatronics and its associates attempt to be as accurate as possible. However, Lavatronics does not warrant that product descriptions or other content of this site is accurate, complete, reliable, current, or error-free. If a product offered by Lavatronics itself is not as described, your sole remedy is to return it in an unused condition.

DIGITAL RECEIVER FIRMWARE/SOFTWARE

Lavatronics supply all digital receivers pre-installed with the manufacturers default firmware unless stated otherwise. This in most cases will be for use as FTA reception only. We do not offer support for ANY third party software/firmware or patches/gifts unless we have specifically stated otherwise and in some cases the loading/patching of software/firmware/gifts may void your warranty. We only support the actal receiver hardware and use for FTA reception unless we have specifically stated otherwise, this includes ALL digital receivers we supply.

VIEWING CARDS

Lavatronics are not in control of satellite transmissions. With respect to all subscription based products, please be aware that all sales are final once subscriptions are activated / registered with the broadcaster, we are not able to offer any refunds or to accept returns once a viewing card has been activated or activation requested. Lavatronics act merely as agents for overseas broadcasters and are not in control of card activation times or any card entitlements update times and whilst we will provide unlimited support as best we can for equipment we have sold we are actually only  "contracted" to supply the satellite equipment (receivers, CAM, viewing card etc.) and not to supply programmes or guarantee card updates. We therefore cannot be held responsible should a broadcaster (or any affiliated company or service supplier) cease broadcasting, change encryption type, move frequency or make any change to the broadcast transmission or its content or card updates whatsover including merging with other broadcasters or re-branding of their services. If current legislation changes then it may become illegal to renew or assist in the service of subscriptions. Viewing by minors of any adult material is prohibited; the end user must take appropriate steps to ensure parental controls are in force.

FAULTY PRODUCT RETURNS (within 7 days of arrival)

All items arriving to the customer in a faulty condition, providing we are notified within 7 working days of arrival, will either be exchanged or refunded in full including shipping and handling costs within 7 working days of the item being returned to and arriving back with us. All returns IN ALL CIRCUMSTANCES must be authorised for return by Lavatronics prior to returning. ANY returns received without first obtaining authorisation may be refused.

FAULTY PRODUCT RETURNS (within warranty period)

All items on this website carry a full 12 month RTB (return to base warranty) unless stated otherwise. The customer is responsible for the return delivery costs however we may also offer to refund this cost in some circumstances. Lavatronics will be responsible for any return delivery costs to the customer of a replacement and/or repaired product. All products will be repaired or replaced whenever possible, or a refund minus our shipping and handling costs or alternative product will be offered where repair or replacement is not available within a reasonable time. Faulty items returned for repair or exchange, where no fault can be found will be charged for return shipping and handling costs. All returns IN ALL CIRCUMSTANCES must be authorised for return by Lavatronics prior to returning. ANY returns received without first obtaining authorisation may be refused.

ORDER CANCELLATIONS / RETURNS

You may cancel your order and claim a refund for the value of the goods ordered excluding our shipping and handling costs at any time up to seven working days after you receive the goods. You have a duty to take reasonable care of the goods, (e.g. if you have opened the box to examine the product you must have done so without using, damaging or marking the product in any way). Note that while in some instances we may offer 'free delivery' there is still an actual cost price of this service to us, in the case of a refund where the free delivery option has been used we will charge you (the customer) for the shipping and handling costs at the cost price to us which can be given to you on request before you make sure your return. We will make the refund as soon as possible and in any event within 30 days. You must return the goods to us in their original condition, unused and in their original packaging.

We cannot cancel your purchase when:

• You return your product without proof of purchase
• There is a contract for services with the product and you have started using the services (e.g. pre paid smart cards or cams)
• The warranty seal has been broken on any item
• The goods were a special order built to your specification.
• If any illegal software / firmware / patches are found to been loaded to the receiver.
• Your order is a pre-order as this is treated as a deposit for goods therefore non-refundable.
• The goods have been used.

We do not offer a try before you buy service

If you cancel your order after we have sent the goods, and they are not defective, of poor quality, mis-described or not fit for their purpose, then you must send them back to us at your own expense. Any 'Free Gifts' received with the product must also be returned. We reserve the right to charge a 15% re-stocking fee, deduct any applicable shipping and handling costs (even if free delivery has been used as per reasons given above) and any applicable credit/debit card charges that we have incured in accepting your original order. You are responsible for the return until it has arrived back with us so please use a registered delivery shipping service when returning goods to ensure you are insured in case of loss or damage to your package, we can advise you of carriers to use if you contact us. All returns IN ALL CIRCUMSTANCES must be authorised for return by Lavatronics prior to returning. ANY returns received without first obtaining authorisation may be refused.

ACKNOWLEDGMENT AND ACCEPTANCE OF ORDER

We will notify you by email as soon as possible to acknowledge receipt of your order and to provide you with an order number. If we are unable to fulfil your order following this acknowledgement, we will contact you by email or telephone advising you of this. Our acceptance of your order will take place upon despatch of the product(s) ordered. If you require any information concerning your order please use the Contact Us page, quoting your order number. We may not accept your order if we have identified a product or pricing error or if we are unable to obtain authorisation for your payment. Please note that we reserve the right to reject any offer to purchase by you at any time.

AVAILABILITY

All items are subject to availability. We will inform you as soon as possible if the goods you have ordered are not available.

INSPECTION

You should inspect the products upon receipt and check that everything specified is included. You will be deemed to have accepted the order unless you notify us upon receipt that there is a problem or you cancel your order in acceptance with your cancellation right and/or you return the goods in accordance with our returns policy and procedure. If you fail to take such action, we are not obligated to accept any rejection by you of the goods at a later date.

Arbitration under this agreement shall be conducted under the rules then prevailing of the current U.K. law. The arbitrators award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.
